The Supreme Court may have ruled same-sex marriage is legal, but that doesn't mean everyone is abiding by it.

A same-sex couple in Kentucky looking for a marriage license on Monday was rejected by Rowan County Clerk Kim Davis -- and the whole incident was caught on video.

Meanwhile here in Victoria, District Attorney Stephen Tyler offered some clarification on what a county clerk can and cannot do in this situation. In a recent letter to Victoria County Clerk Clerk Heidi Easley, Tyler basically said using personal judgement to go against a Supreme Court decision is a violation of a clerk's duties. In his letter published by the Victoria Advocate, Tyler summed it up by saying "[Texas Attorney General Ken Paxton] is not the lifeguard in this pool, and the water is deep and dark, so all swimmers will swim at their own risk." Tyler was referring to a statement made by Paxton that said that Justices of the Peace and Judges could exercise their religious freedom by not performing ceremonies or issuing marriage licenses to same-sex couples.

Back to the Kentucky couple at the beginning of this story, David Moore recalled the episode on his Facebook page, writing, "We were denied a marriage license on Monday, July 6 at the Rowan County Clerk's office."

A police officer was even summoned around the 9:30 mark and it appears that people behind Moore and his partner get helped before them.

Davis is already staring down the barrel of a lawsuit filed by the ACLU for refusing to obey the law.

Davis is not actually seen on camera until after the 11-minute mark and even then it's only for a short time because she asks not to be shown.

Davis' decision to deny the license is part of a trend around the country where officials have not cooperated with the Supreme Court's decision.
